Terms & Conditions
What is provided under the plan (“the services”):
1. Breakdown services: The provision of repairs to or replacement of the digital satellite, cable, or terrestrial system with no bills to pay in the event of a breakdown caused by a mechanical or electrical fault with your equipment.
2. Customer services: We will provide a telephone helpline offering help & assistance in the respect of your protection plan. The helpline can be reached on 0800 954 5668 and is open Monday - Friday 10am - 6pm excluding bank holidays.
3. Your protection plan will cover the equipment specified in the plan details (“the equipment”) In the event of a mechanical breakdown of the equipment; you must inform us immediately on 0800 954 5668. We will repair or replace (at our sole discretion) any defective part covered by your protection plan free of any further charge. In the event of a replacement being necessary, no guarantee can be made that any replacement equipment will be new nor as to the make or model supplied/loaned as these are subject to availability.
What is not provided under the plan:
Repairs or replacement of equipment will not be provided, and we reserve the right to charge you for any costs arising from a call out, in any of the following events:
1. The equipment is still covered by any manufacturer's, supplier's or repairer's warranty.
2. The equipment or any part thereof being recalled by your digital services provider, the supplier or manufacturer of your equipment or any other supplier due to a generic manufacturer defect or any other reason.
3. Any unauthorised modification of the equipment including (without limitation) any upgrade not authorised by your digital services provider or addition of any accessories not approved by your digital services provider, the supplier or manufacturer of your equipment.
4. Your failure to follow the equipment operating instructions or manufacturers guidelines.
5. Use of your equipment in a non-domestic or commercial environment.
6. Loss of the equipment, theft, attempted theft, malicious damage or damage caused by neglect, fire, explosion, dampness, liquid spillage, or foreign bodies inside the receiver box.
7. Damage to the equipment through floods, lightning, storms, frost or other bad weather conditions.
8. Any problem directly or indirectly caused by the domestic supply of electricity.
9. No fault being found with your equipment.
What is not covered under the plan:
The repair plan does not cover, and we will be under no liability to you in respect of the following:
1. Faults occurring with your systems before the plan start date (for any claims within the first 31 days, a £65 callout charge will be issued. Three months will be added to your contract)
2. Routine maintenance, cleaning and servicing.
3. Work required by you to take place outside the normal working hours of 8.00am to 5.00pm Monday to Sunday excluding public holidays in England.
4. Cosmetic damage such as damage to paintwork or dents or scratches to the equipment.
5. Replacement of any item that is intended to be replaceable including (without limitation) fuses and batteries.
6. Rust and or corrosion damage to minidish and or low noise block.
7. Loss or damage to interactive or viewing cards (please refer to your digital services provider directly)
8. Equipment not properly installed by your digital services provider authorised installers.
9. Equipment which has previously been repaired but not by our or your digital services provider's approved repairers.
10. Any equipment which is not working in accordance with the manufacturers specification at the plan start date..
11. Loss of programmes or data saved to any hard drive or storage device.
12. Components of any integrated digital television are protected.
13. Any part of a system that is not wholly owned by you such as a communal dish or distribution system.
14. Relocation of the equipment in the event that you move property.
15. Any cost arising from the change of analogue to digital broadcasting including the termination of the analogue transmission.
Missed appointments:
We reserve the right to charge you £65.00 for our call out costs if a scheduled appointment has been confirmed, but missed by you.
Faulty equipment
Where replacement equipment is provided any faulty equipment becomes our property.
Governing law:
This plan is governed by the laws of England & Wales and the jurisdiction of the English courts will apply. This protection plan does not affect your statutory rights as a consumer.
Plan Implementation:
Your Satellite Protection Plan will be sent out and delivered to you within 14 working days from receipt of your payment.
Transferring your plan:
Your plan cannot be transferred to any other equipment unless it is replacement equipment provided by us
Cancelling you plan:
Under the Consumer Protection (Distance Selling) Regulations 2000, you may cancel the protection plan and receive a full refund by giving notice in writing to the address set out below at any time up to and including the 8th working day (excluding Saturdays, Sundays and public holidays) after you receive this plan document, or if later, from our receipt of your first payment (“the Cooling Off Period”). If you cancel the protection plan in the Cooling Off Period but have received the service, repair or replacement under this plan we reserve the right to make a responsible charge for the direct costs we have incurred in providing the services you have received.
After the Cooling Off Period you may cancel this protection plan at any time by giving us 30 days notice in writing. Subject to your obligation to pay the Minimum payment (defined below) we will issue you with a pro-rata refund of the amount paid by you for each remaining full month of the plan.
We are entitled to cancel the plan by giving you 14 days notice in writing to your last known address. If we cancel the plan we will issue you will a pro-rata refund of the amount paid by you for each remaining full month of the plan.
Payment
In consideration of the Services we provide, you have agreed to pay for a minimum of 12 months services (“the Minimum Payment”) in keeping with the payment arrangements that were agreed at the time of making the agreement and as set out in the Plan Details.
If the Protection Plan is renewed then the Annual Payment will be due on the Renewal Date unless we agree otherwise in writing.
Should a payment not be received in 14 days after its due date, we reserve the right to delay or suspend the Services we have agreed to supply to you and/or validation of this protection plan agreement until the payment is received in full and in cleared sums or the agreement is cancelled.
Term
This Protection Plan starts on the Plan Start Date and will continue for the period chosen by you and recorded as the plan duration. On the renewal date, and on each anniversary of that date, we will renew your protection plan automatically for a further term of 12 months unless you cancel the protection plan in accordance with these terms and conditions.
Liability
If in the course of providing the Services any information or programmes are deleted from the equipment we will not be liable for any loss suffered. We will not be liable for service delays or failures where we are faced with circumstances outside our reasonable control; such as acts of god, outbreak of hostilities, riot, civil disturbance, acts of terrorism, acts of government or other competent authority, industrial action, fire, subsidence, explosion, flood, snow, fog or other bad weather conditions, or default sub-contractors.
Exclusion of third party rights:
The plan is for your benefit only and any permitted transferee at our discretion and no rights or benefits will be given to any other third party under the plan.
The provisions of the contracts (Rights of Third Parties) Act 1999 will not apply
Data Protection
Your details will be held and used by Morgan Nicholson Ltd and your name and address will be used for the administration of the plan. Save as permitted or required by law, we will not provide your data to any third party without your prior consent although we may supply it to any sub-contractor or agent we may use for the purposes of carrying out our obligations under your protection plan. Under the Data Protection Act 1998 you have the right to ask for a copy of the information held about you, details of how it is being used at any time, and to have that information corrected if it is inaccurate.
